TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-30-100 SO AS TO PROHIBIT A HEALTH CARE PROFESSIONAL FROM REFERRING A PATIENT FOR TREATMENT OR TESTS TO A FACILITY OR AN ENTITY IN WHICH THE PROFESSIONAL HAS A FINANCIAL INTEREST UNLESS THE PROFESSIONAL FIRST NOTIFIES THE PATIENT IN WRITING OF THE NATURE OF THE FINANCIAL INTEREST, AND PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 40-30-100. A health care professional may not refer a patient for treatment or tests to a facility or an entity in which the professional has a financial interest unless the professional first notifies the patient in writing of the nature of the financial interest. This section does not apply to emergency referrals or admissions."
SECTION 2. This act takes effect July 1, 1993, and applies with respect to referrals after June 30, 1993.
