A JOINT RESOLUTION

TO PROVIDE THAT THE CONFEDERATE BATTLE FLAG MAY NOT BE FLOWN ABOVE THE STATE HOUSE IN COLUMBIA AFTER JANUARY 1, 1995, UNLESS A MAJORITY OF THE QUALIFIED ELECTORS OF THIS STATE AT A REFERENDUM HELD AT THE SAME TIME AS THE 1994 GENERAL ELECTION SO APPROVE, TO PROVIDE FOR THE MANNER IN WHICH THIS REFERENDUM SHALL BE CONDUCTED, AND TO PROVIDE THAT NO OTHER FLAG OF THE CONFEDERATE STATES OF AMERICA, INCLUDING THE STARS AND BARS MAY BE FLOWN ABOVE THE STATE HOUSE WITHOUT THE AUTHORIZATION OF THE GENERAL ASSEMBLY BY ACT OR JOINT RESOLUTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. (A) Notwithstanding any other provision of law, the Confederate Battle Flag which now flies above the State House in Columbia may not be flown at this location after January 1, 1995, unless a majority of the qualified electors of this State voting in a statewide referendum at the time of the 1994 general election vote in favor of the continued flying of this flag above the State House. The State Election Commission must place the question contained herein on the general election ballot in November, 1994. The state election laws shall apply to the referendum, mutatis mutandis. The State Board of Canvassers shall publish the results of the referendum and certify them to the Secretary of State. If the result of this referendum is not in favor of continuing to fly this flag above the State House, the flag may not be flown at this location after January 1, 1995.

(B) The question put before the voters at the 1994 referendum shall read as follows: "Do you favor allowing the Confederate Battle Flag to continue to be flown above the State House in Columbia?"

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word "Yes", and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word "No".

(C) No other Flag of the Confederate States of America, including the Stars and Bars, may be flown above the State House in Columbia without the authorization of the General Assembly by act or joint resolution.

SECTION 2. This joint resolution takes effect upon approval by the Governor.
