TO AMEND TITLE 13, CHAPTER 7, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NUCLEAR ENERGY, BY ADDING ARTICLE 11 SO AS TO PROHIBIT THE TRANSPORTATION OF SPENT NUCLEAR FUEL OR HIGH-LEVEL RADIOACTIVE WASTE ON HIGHWAYS AND RAILWAYS IN SOUTH CAROLINA UNLESS AN ENVIRONMENTAL IMPACT STATEMENT HAS BEEN PREPARED IN ACCORDANCE WITH THE NATIONAL ENVIRONMENTAL POLICY ACT AND THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL HAS CERTIFIED THAT THE TRANSPORTATION AND STORAGE OF THIS MATERIAL DOES NOT POSE A SIGNIFICANT RISK TO SOUTH CAROLINA CITIZENS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
Section 13-7-1110. Notwithstanding any other provision of law, no spent nuclear fuel and high-level radioactive waste destined for storage in South Carolina may be transported on roads, highways, or railways in South Carolina unless and until an environmental impact statement has been prepared in accordance with the National Environmental Policy Act, and the Department of Health and Environmental Control has certified that the transport and storage of spent nuclear fuel and high-level radioactive waste in South Carolina poses no significant risk to the health and safety of South Carolina citizens."
SECTION 2. This act takes effect upon approval by the Governor.
