TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-11-350 SO AS TO AUTHORIZE THE GOVERNING BODY OF A PUBLIC SERVICE DISTRICT WHICH PROVIDES ONLY SEWER SERVICES AND A MAJORITY OF WHICH IS LOCATED WITHIN THE CORPORATE BOUNDARIES OF A MUNICIPALITY TO TRANSFER ITS ASSETS AND LIABILITIES TO A MUNICIPALITY UPON THE ASSUMPTION BY THE MUNICIPALITY OF THE RESPONSIBILITIES OF THE DISTRICT AND A FAVORABLE REFERENDUM OF THE QUALIFIED ELECTORS OF THE DISTRICT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 6-11-350. The governing body of a public service district which only provides the delivery of sewer services and a majority of which is located within the corporate boundaries of a municipality is authorized to transfer its assets and liabilities for the delivery of sewer services to that municipality. The municipality must assume, by ordinance, the responsibilities of the district for the delivery of sewer services as set forth in the legislation creating the public service district. The transfer is not completed until the question of the transfer has been submitted to and approved by a favorable referendum vote of a majority of the qualified electors of the district voting in the referendum. Any public service district which transfers its assets and liabilities as provided in this section must dissolve the public service district upon the completion of the transfer and upon the assumption or other appropriate disposition by the municipality of all of the responsibilities and obligations of the public service district. The referendum vote may be conducted either as a special referendum within the district for this specific purpose or at the same time as a general election as determined by the county election commission."
SECTION 2. This act takes effect upon approval by the Governor.
