TO AMEND CHAPTER 21, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO WATERCRAFT EQUIPMENT AND OPERATION, SO AS TO PROHIBIT PERSONS OTHER THAN NATURAL RESOURCES OFFICIALS, LAW ENFORCEMENT OFFICIALS AND OTHER GOVERNMENTAL OFFICIALS WHO ARE AUTHORIZED BY LAW TO CARRY FIREARMS FROM POSSESSING LOADED FIREARMS WHILE RIDING IN OR ON A MOVING BOAT OR OTHER WATERCRAFT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 21, Title 50 of the 1976 Code is amended by adding:
"Section 50-21-136. No person other than authorized Natural Resources officials, law enforcement officials, or other governmental officials authorized by law to carry firearms, shall possess or display a loaded firearm while operating or riding in or upon a boat or other watercraft. Nothing in this section may be construed to prohibit a person possessing a valid hunting or fishing license from possessing a firearm and ammunition as permitted under any other provision of law while engaged in hunting or fishing, provided that the firearm may not be loaded while the boat or other watercraft is in motion. Any person violation the provisions of this section is guilty of a misdemeanor and upon conviction must be fined not less than twenty-five dollars nor more than one hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
