A CONCURRENT RESOLUTION

TO REQUEST THE SUPREME COURT TO AMEND THE COURT RULE REGARDING LAWYER DISCIPLINE TO PROVIDE FOR SPEEDY INVESTIGATIONS OF COMPLAINTS AND SPEEDY RESOLUTIONS OF FORMAL CHARGES.

Whereas, the South Carolina Constitution confers to the Supreme Court the power to discipline persons admitted; and

Whereas, the Court has promulgated a Court Rule that addresses the subject of attorney discipline; and

Whereas, this Court Rule does not provide a specific time period within which investigations must be completed after a complaint regarding lawyer misconduct is filed; and

Whereas, this Court Rule also does not provide a specific time period within which formal charges must be resolved after they are filed; and

Whereas, years may pass before a complaint is finally resolved because of the lack of definitive time periods within which investigations must be conducted and formal charges resolved. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

The members of the General Assembly request the Supreme Court to amend the Court Rule regarding lawyer discipline to provide for speedy investigations of complaints and speedy resolutions of formal charges.

Be it further resolved that a copy of this resolution be forwarded to each member of the South Carolina Supreme Court
