TO AMEND CHAPTER 11, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SPECIAL HUNTING AND FISHING PROVISIONS, BY ADDING SECTION 50-11-13 SO AS TO PROVIDE THAT IT IS UNLAWFUL TO HUNT MIGRATORY BIRDS WITH A SHOTGUN CAPABLE OF HOLDING MORE THAN THREE SHELLS, UNLESS IT IS PLUGGED WITH A ONE-PIECE FILLER THAT IS INCAPABLE OF REMOVAL WITHOUT DISASSEMBLING THE GUN, SO ITS TOTAL CAPACITY DOES NOT EXCEED THREE SHELLS; TO DEFINE "DISASSEMBLING THE GUN" FOR THE PURPOSES OF THIS SECTION AND FOR LAW ENFORCEMENT PURPOSES IN THIS STATE; AND TO PROVIDE PENALTIES FOR THE VIOLATION OF THIS SECTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 19, Title 50, of the 1976 Code is amended by adding:
"Section 50-11-13. (A) It is unlawful to hunt migratory birds with a shotgun of any description capable of holding more than three shells, unless it is plugged with a one-piece filler, incapable of removal without disassembling the gun, so its total capacity does not exceed three shells.
(B) For purposes of enforcing laws relating to hunting migratory birds in this State, 'disassembling the gun' means separating the assembled gun into any two or more of its parts, with or without the use of a tool.
(C) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, is subject to the punishment provided for a violation of Section 50-11-10(B), and to any other penalty provided by law."
SECTION 2. This act takes effect upon approval by the Governor.
