A BILL

TO AMEND SECTION 30-4-90, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MINUTES OF MEETINGS OF PUBLIC BODIES, SO AS TO REQUIRE THE PROPOSED OR DRAFT MINUTES TO BE AVAILABLE WITHIN THIRTY DAYS AFTER MEETING IF THE PUBLIC BODY MEETS LESS FREQUENTLY THAN MONTHLY AND TO REQUIRE THAT IF A PUBLIC BODY MAINTAINS AN INTERNET WEBSITE, THE MINUTES MUST BE POSTED TO THE SITE WITHIN THIRTY DAYS AFTER THEY ARE ADOPTED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 30-4-90(b) of the 1976 Code is amended to read:

"(b) The minutes shall be are public records and shall must be available within a reasonable time after the meeting except where such the disclosures would be inconsistent with Section 30-4-70 of this chapter. If a public body meets less frequently than monthly, proposed or draft minutes for that meeting must be available within thirty days after the meeting of the public body. If a public body maintains an internet website, the minutes must be posted to the site within thirty days after they are adopted."

SECTION 2. This act takes effect upon approval by the Governor.
