REVENUE IMPACT1
This bill is expected to increase local government revenues by $34,500 in FY 1999-00. This bill would have no impact on state revenues.
Explanation
This bill raises the fee to register a notary commission, public office, trade name, or partnership with county clerks of court or deed registrars in this State from $2 to $5. A notary commission must be renewed every ten years. The Secretary of State commissions all notaries and elected and appointed officials for the State. These officials should then register the commission in their respective county. It is difficult to assess the number of registrations in a given fiscal year since there is no enforcement to register and record keeping practices of counties are not uniform. Based on actual registrations for selected counties in FY 1997-98 and anticipated renewals by the Secretary of State, the BEA estimates 11,500 commissions will be registered at the county level in FY 1999-00. Multiplying 11,500 by the fee increase of $3 will yield $34,500 in FY 1999-00. Since the counties retain all proceeds, this bill would not impact state revenues. This bill is expected to increase local government revenues by $34,500 in FY 1999-00.

TO AMEND SECTION 8-21-310, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE FEES TO BE CHARGED FOR FILING OR RECORDING A COMMISSION OF NOTARY PUBLIC OR OTHER PUBLIC OFFICE, LICENSE OR PERMIT TO PRACTICE ANY PROFESSION OR TRADE, OR NOTICE OF FORMATION OR DISSOLUTION OF A PARTNERSHIP OR PROFESSIONAL ASSOCIATION, SO AS TO CHANGE THE COST FOR THE FILING FROM TWO DOLLARS TO FIVE DOLLARS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 8-21-310(15) of the 1976 Code is amended to read:
"(15) for filing or recording any commission of notary public or other public office, license, or permit to practice any profession or trade, notice of formation or dissolution of any partnership, two five dollars;"
SECTION 2. This act takes effect upon approval by the Governor.
