A BILL

TO AMEND SECTION 56-1-2100, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENTS FOR THE ISSUANCE OF A COMMERCIAL DRIVER LICENSE, SO AS TO REQUIRE THE DEPARTMENT OF PUBLIC SAFETY TO TAKE REASONABLE STEPS TO ENSURE THAT THE NAME OF AN APPLICANT APPLYING FOR A LICENSE OR RENEWAL OF A LICENSE WITH A HAZARDOUS MATERIALS ENDORSEMENT DOES NOT APPEAR ON THE FEDERAL GOVERNMENT'S TERRORIST WATCH LIST AND IS RESIDING IN THE UNITED STATES IN COMPLIANCE WITH ALL APPLICABLE IMMIGRATION LAWS OF THIS COUNTRY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-1-2100 of the 1976 Code, as last amended by Act 265 of 2000, is further amended by adding:

"(G) In addition to all other requirements for the issuance of a commercial driver license with a hazardous materials endorsement, the department must take reasonable steps to ensure the applicant's name does not appear on the federal government's terrorist watch list and is residing in the United States in compliance with all applicable immigration laws of this country."

SECTION 2. This act takes effect upon approval by the Governor and applies to a commercial driver license issued after the effective date of this act.
