A CONCURRENT RESOLUTION

TO EXPRESS THE BELIEF OF THE GENERAL ASSEMBLY AND TO DIRECT THE STATE ELECTION COMMISSION IN DEVELOPING THE "STATE PLAN" FOR SOUTH CAROLINA UNDER THE FEDERAL HELP AMERICA VOTE ACT (HAVA) WHICH PROVIDES ELECTION ASSISTANCE TO THE VARIOUS STATES THROUGH GRANTS TO INCLUDE THE PROVISIONS OF SECTION 7-13-1660 OF THE 1976 CODE WHICH ALLOWS COUNTY AND MUNICIPAL GOVERNING BODIES TO DETERMINE THE KIND AND TYPE OF VOTING MACHINES USED IN THAT COUNTY OR MUNICIPALITY.

Whereas, the Federal Help America Vote Act of 2002 provides election assistance to the various states through disbursement of grant monies; and

Whereas, each state is required to develop a "State Plan" that delineates the manner in which these grant monies will be used to improve elections in that state; and

Whereas, Section 7-13-1660 of the 1976 Code provides that the governing body of a county or municipality may determine the kind or type of voting machines used at elections held in that jurisdiction; and

Whereas, the State Election Commission and the other parties involved in the development of South Carolina's "State Plan" under the Help America Vote Act have not fully incorporated the provisions of Section 7-13-1660 into the "State Plan"; and

Whereas, the members of the General Assembly believe that the citizens of South Carolina would be best served if the provisions of Section 7-13-1660 were incorporated into and given full force and effect in the "State Plan" of South Carolina under the Help America Vote Act. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly express their belief and hereby direct the State Election Commission in developing the "State Plan" for South Carolina under the Federal Help America Vote Act (HAVA) to include in the "State Plan" the provisions of Section 7-13-1660 of the 1976 Code which allows county and municipal governing bodies to determine the kind and type of voting machine used in that jurisdiction.

Be it further resolved that a copy of this resolution be forwarded to the State Election Commission.
