AN ACT TO AMEND ACT 69 OF 1963, RELATING TO THE RICHLAND COUNTY HISTORIC PRESERVATION COMMISSION, SO AS TO INCREASE THE NUMBER OF MEMBERS FROM SIX TO SEVEN, TO CHANGE THE PROVISIONS FOR RECOMMENDING PERSONS FOR APPOINTMENT AND THE LENGTH OF THE TERMS OF MEMBERS, TO LIMIT THE NUMBER OF CONSECUTIVE TERMS WHICH A MEMBER MAY SERVE TO TWO, AND TO REQUIRE COPIES OF THE ANNUAL AUDIT TO BE FILED WITH THE RICHLAND COUNTY COUNCIL, THE COLUMBIA CITY COUNCIL, AND THE RICHLAND COUNTY CLERK OF COURT.

Be it enacted by the General Assembly of the State of South Carolina:

Richland County Historic Preservation Commission

SECTION 1. The first paragraph of Section 3 of Act 69 of 1963 is amended to read:

"The commission is composed of seven resident electors of the county. The Richland County Legislative Delegation, the Richland County Council, and the Columbia City Council each shall recommend two members to the Governor, and the president of the Historic Columbia Foundation, Inc., or his designee must be member. The Governor shall appoint the members for terms of four years and until their successors are appointed and qualify. The members serving on the effective date of this act shall continue to serve until the expiration of their terms. The terms of their successors must be staggered so that the length of the terms of the two recommended by each governmental entity must be two years apart. No member may serve more than two consecutive terms."

Filing of copies of audit

SECTION 2. Section 6 of Act 69 of 1963 is amended to read:

"Section 6. The commission shall conduct its affairs on the fiscal year basis employed by Richland County. As shortly after the close of its fiscal year as practicable an audit of its affairs must be made by a certified public accountant designated by the commission. Copies of the audit, incorporated into an annual report of the commission, must be filed with the Richland County Council, Richland County Delegation, the Columbia City Council, and the clerk of court for Richland County."

SECTION 3. This act takes effect upon approval by the Governor.
