AN ACT TO AMEND SECTION 58-31-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE POWERS OF THE PUBLIC SERVICE AUTHORITY, SO AS TO AUTHORIZE THE AUTHORITY TO CONSTRUCT A WATER CONTROL STRUCTURE ON BIGGIN CREEK IN THE OLD SANTEE STATE PARK IN BERKELEY COUNTY.

Whereas, the Public Service Authority and the Department of Parks, Recreation and Tourism are cosponsors of a state park to be built in Berkeley County, the theme of which centers on the old Santee Canal, a pre-1850 navigation project; and

Whereas, the construction of a water control structure on Biggin Creek is necessary to permit the maintenance of an adequate flow of water in the creek and the adjacent canal because the recent rediversion of water from this area into the Santee River basin has caused water levels in Biggin Creek and the canal to decrease; and

Whereas, the water level must be increased to make the canal the focal point of the park; and

Whereas, the cost of construction will be provided initially by the Public Service Authority. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Powers increased

SECTION 1. Section 58-31-30(5) of the 1976 Code is amended to read:

"(5) To divert water from the Tail Race Canal by means of canals, flumes, or otherwise and to build, construct, maintain, and operate canals, dams, locks, aqueducts, reservoirs, draw-spans, ditches, drains, and roads, and to lay and construct any tunnels, penstocks, culverts, flumes, conduits, mains, and other pipes necessary or useful in connection therewith."
