A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-11-310 SO AS TO PROVIDE THAT SPECIAL PURPOSE DISTRICTS, NOT OTHERWISE EMPOWERED TO CONDEMN BY LAW, ARE GRANTED THE POWER OF EMINENT DOMAIN AND FOR THIS PURPOSE ARE CONSIDERED TO BE "CONDEMNORS" WITHIN THE MEANING OF THE SOUTH CAROLINA EMINENT DOMAIN PROCEDURE ACT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 11, Title 6 of the 1976 Code is amended by adding:

"Section 6-11-310. Special purpose districts and public service districts of this State, not otherwise empowered to condemn by law, are granted the power of eminent domain and for this purpose are considered to be 'condemnors' within the meaning of the South Carolina Eminent Domain Procedure Act."

SECTION 2. This act takes effect upon approval by the Governor.
