TO AMEND ACT 1120 OF 1960, AS AMENDED, RELATING TO THE LIBERTY-CHESNEE-FINGERVILLE WATER DISTRICT IN SPARTANBURG COUNTY, SO AS TO PROVIDE FOR THE ELECTION OF THE COMMISSION OPERATING AND MANAGING THE DISTRICT AND DELETE THE PROVISIONS FOR APPOINTMENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 2, Act 1120 of 1960, as last amended by Act 293 of 1985, is further amended to read:
"Section 2. The district is operated and managed by a commission known as `Liberty-Chesnee-Fingerville Water Commission', which consists of five resident electors of the district. The terms of office of the members of the commission are must be elected for six terms of four years at each general election. In all cases the Members of the commission shall hold office until their successors are elected and qualify. The commission must be appointed by the Governor upon the recommendation of the legislative delegation from the county. Any A vacancy occurring in the office of commissioner by reason of death, resignation, or otherwise, must be filled for the remainder of the unexpired term by appointment in the manner of the original appointment by the Governor."
SECTION 2. The members of the Liberty-Chesnee-Fingerville Water Commission serving on the effective date of this act continue to serve until new members are elected pursuant to this act. The new members must be elected beginning with the 1992 General Election.
SECTION 3. This act takes effect upon approval by the Governor.
