A JOINT RESOLUTION TO DIRECT THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION, IN COOPERATION WITH THE SOUTH CAROLINA COMMISSION ON AGING AND THE STATE AGENCY OF VOCATIONAL REHABILITATION, TO STUDY THE ISSUANCE AND USE OF RESTRICTED DRIVERS' LICENSES FOR THE AGING AND PERSONS WITH HANDICAPPING CONDITIONS AS A MEANS TO ENHANCE THE INDEPENDENCE AND SELF-SUFFICIENCY OF THESE PERSONS AND TO REPORT TO THE JOINT LEGISLATIVE COMMITTEE ON AGING; AND TO AMEND SECTION 56-5-3880, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CLOSURE OF HIGHWAYS FOR RUNNING EVENTS, SO AS TO PROVIDE AN ALTERNATIVE BRIDGE TO THE COOPER RIVER BRIDGE FOR THAT RUN AND PROVIDE CONDITIONS.

Whereas, in establishing policy and issuing drivers' licenses, the State has strived to balance public safety with the rights and liberties of its citizens; and

Whereas, among other things, this balance of interests has been achieved through permitting restricted licenses; and

Whereas, restricted licenses protect the public safety while providing a privilege to a person that may enhance the person's daily living and ability to be independent and self-sufficient; and

Whereas, a restricted license may be appropriate when a person's ability may be somewhat diminished yet still adequate to drive under certain conditions; and

Whereas, these conditions, for example, may include prohibitions against driving at night or driving on interstate highways or roadways with a speed limit exceeding fifty miles an hour; and

Whereas, restricted drivers' licenses and their conditions are determined on a case-by-case basis but do not appear to be issued very widely in this State; and

Whereas, a study of the issuance and use of restricted licenses for aging persons and persons with handicapping conditions in this State would be helpful in developing policy and procedures for using these licenses as a means to enhance the independence and self-sufficiency of these persons. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Restricted driver's license study

SECTION 1. The South Carolina Department of Highways and Public Transportation, in cooperation with the South Carolina Commission on Aging and the State Agency of Vocational Rehabilitation, shall study the current law, regulations, and policies regarding the issuance and use of restricted drivers' licenses in this State with special attention to the use of these licenses as a means to enhance the independence and self-sufficiency of aging persons and those persons with handicapping conditions in this State. A report of the study must be submitted to the Joint Legislative Committee on Aging by January 1, 1993.

Use of highways for race events, Cooper River Bridge Run

SECTION 2. Section 56-5-3880 of the 1976 Code is amended to read:

"Section 56-5-3880. The South Carolina Department of Highways and Public Transportation may close state highways, roadways, or bridges to allow marathons or other running events when the race or event is open to all persons including the handicapped if in the opinion of the district engineer the race or event may be conducted in a safe manner. The department, city, county, organization, and sponsors of the race or event are immune from liability except for gross negligence from incidence arising from participation in or association with the race or event.

If the John P. Grace Memorial Bridge is not available for the annual Cooper River Bridge Run and Walk in Charleston County, the Silas N. Pearman Bridge must be made available for the event, if a contingency plan for vehicular traffic can be developed, provided, that if the Cooper River Bridge Run and Walk is not open to persons sixty-five years of age or older, neither bridge may be used for this event."

Time effective

SECTION 3. This joint resolution takes effect upon approval by the Governor.
