A BILL

TO AMEND SECTION 15-78-60, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS TO TORT LIABILITY FOR GOVERNMENTAL ENTITIES, SO AS TO PROVIDE THAT A GOVERNMENTAL ENTITY IS NOT LIABLE FOR A LOSS RESULTING FROM MAINTENANCE, SECURITY, OR SUPERVISION OF A NATURAL RESOURCE ATTRACTION UNLESS THE OCCURRENCE RESULTING IN THE LOSS AFFIRMATIVELY IS CAUSED BY A NEGLIGENT ACT OF A GOVERNMENTAL ENTITY OR ITS EMPLOYEE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 15-78-60(a) of the 1976 Code is amended by adding an appropriately numbered item to read:

"( ) maintenance, security, or supervision of a natural resource attraction including, but not limited to, beaches, natural bodies of water, and forests, unless the occurrence resulting in the loss affirmatively is caused by a negligent act of a governmental entity or its employee."

SECTION 2. This act takes effect upon approval by the Governor.
