A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-35 SO AS TO PROHIBIT THE HUNTING, CATCHING, TAKING, KILLING, OR ATTEMPTING TO HUNT, CATCH, TAKE, OR KILL A GAME BIRD OR GAME ANIMAL WHICH HAS BEEN RELEASED FOR THE IMMEDIATE PURPOSE OF HUNTING, CATCHING, TAKING, OR KILLING AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-11-35. (A) It is unlawful for a person to hunt, catch, take, kill, or attempt to hunt, catch, take, or kill a game bird or game animal which has been released from a cage or similar enclosure for the immediate purpose of hunting, catching, taking, or killing.

(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than one hundred nor more than five hundred dollars or imprisoned for not less than thirty nor more than ninety days, or both."

SECTION 2. This act takes effect upon approval by the Governor.
