TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING CHAPTER 68 TO TITLE 44 SO AS TO PROVIDE FOR THE LITTER RECYCLING ACT BY SETTING FORTH DEFINITIONS AND THE REQUIREMENTS OF THE BUDGET AND CONTROL BOARD AND THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Title 48 of the 1976 Code is amended by adding:
Section 44-68-10. As used in this chapter:
(1) 'Litter' means waste material including, but not limited to, bottles, glass, crockery, cans, scrap metal, paper, plastic, rubber, and garbage capable of recycling.
(2) 'Litter receptacle' means containers designed and adopted by regulation by the State Budget and Control Board and standardized as to size, shape, capacity, and color.
(3) 'Recycling' means the process of separating, cleaning, treating, and reconstituting used or discarded litter-related material to recover and reuse the resources contained in it.
Section 44-68-20. Litter receptacles must be placed at locations within the capitol complex mall in Columbia as specified by regulation of the Budget and Control Board and at locations within buildings housing state and local agencies as specified by regulation of the South Carolina Department of Health and Environmental Control. A litter receptacle is not required to be located at each state and local agency building.
Section 44-68-30. The Department of Health and Environmental Control shall remove the litter from the receptacles at least once weekly or when full and transfer it to a recycling center.
Section 44-68-40. The Budget and Control Board may promulgate regulations to carry out the provisions of this chapter."
SECTION 2. This act takes effect upon approval by the Governor.
