TO AMEND SECTION 51-13-720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE APPOINTMENT AND TERMS OF THE MEMBERS OF THE PATRIOT'S POINT DEVELOPMENT AUTHORITY, SO AS TO REVISE THE MEMBERSHIP AND TERMS AND PROVIDE FOR THE ELECTION OF THE CHAIRMAN INSTEAD OF APPOINTMENT, ELECTION OF OTHER OFFICERS, EXPIRATION OF THE TERMS OF THE CURRENT MEMBERS, AND INITIAL TERMS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 51-13-720 of the 1976 Code, as last amended by Act 349 of 1990, is further amended to read:
"Section 51-13-720. (A) Members of the authority must be appointed by the Governor as follows:
(1) one member by each United States Senator for a six-year term;
(2) one member by each of three United States Congressmen for a two-year term. The congressmen representing the first, third, and sixth districts appoint the members for one term, and the congressmen representing the second, fourth, and fifth districts appoint the members for the following term. The rotation provided in this item continues for succeeding terms;
(3) one member appointed by each of the chairmen of the Senate General Committee and the House Labor, Commerce and Industry Committee for a two-year term;
(4) five members appointed by the Governor, with the advice and consent of the Senate, for a four-year term;
(5) the Executive Director of the South Carolina Department of Parks, Recreation and Tourism, or his designee one upon the joint recommendation of the Chairman of the House Ways and Means Committee and the Speaker of the House, one upon the joint recommendation of the Chairman of the Senate Finance Committee and the President Pro Tempore of the Senate, and three to be appointed by the Governor. The Governor shall appoint the chairman.
(B) The terms of the members are for four years and serve until their successors are appointed and qualify. Members may succeed themselves. Vacancies must be filled in the same manner of the original appointment for the remainder of the unexpired term. The members shall elect a chairman, vice-chairman, and other necessary officers from their membership."
SECTION 2. The terms of the current members of the Patriot's Point Development Authority expire and the terms of the members provided in this act begin thirty days after this act's effective date.
SECTION 3. This act takes effect upon approval by the Governor.
