A BILL

TO AMEND SECTION 7-13-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE TIME OF CONDUCTING A PARTY PRIMARY, SO AS TO CHANGE THE DATE ON WHICH IT IS HELD FROM THE SECOND TUESDAY IN JUNE TO THE FOURTH TUESDAY IN AUGUST.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 7-13-40 of the 1976 Code, as last amended by Act 363 of 1988, is further amended to read:

"Section 7-13-40. In the event that If a party shall nominate nominates candidates by party primary election, a party primary election must be held by the party on the second fourth Tuesday in June August of each general election year and a second and third primary election each two weeks successively thereafter, if necessary."

SECTION 2. This act takes effect upon approval by the Governor.
