TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 11 TO CHAPTER 43, TITLE 44 SO AS TO PROVIDE FOR THE TRANSPLANT LIFELINE PROGRAM TO BE ADMINISTERED BY THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 43, Title 44 of the 1976 Code is amended by adding:
Section 44-43-910. The South Carolina Transplant Lifeline for Children Program is established to provide financial support for nonexperimental organ and tissue transplantation for children under the age of twenty-one years regardless of income.
Section 44-43-920. The program must be administered by the South Carolina Department of Health and Environmental Control which shall promulgate regulations to enforce the provisions of this article.
Section 44-43-930. The department shall establish the South Carolina Transplant Lifeline for Children Trust Fund to which contributions are made on behalf of a designated child or any child requiring nonexperimental organ or tissue
transplantation. Residual donations made on behalf of a specific child may be used for another child. Administrative costs must be assumed by the State, and donations must not be used for that purpose.
Section 44-43-940. The department shall employ a director and necessary staff to coordinate the program. The program must provide for financial and transportation assistance for patients and families, pretransplant evaluation, consultation, case management, referrals, post-transplant follow-ups, coordination of funding resources, and development of a fund raising plan."
SECTION 2. This act takes effect upon approval by the Governor.
