TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-462 SO AS TO PROVIDE FOR A PREMIUM REDUCTION FOR AN AUTOMOBILE INSURANCE POLICY WHEN THE PRINCIPAL OPERATOR OF THE INSURED AUTOMOBILE IS INSURED UNDER THE POLICY, IS FIFTY-FIVE YEARS OF AGE OR OLDER, AND HAS COMPLETED SUCCESSFULLY A MOTOR VEHICLE ACCIDENT PREVENTION COURSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-73-462. (A) A rate or premium charge filed by an automobile insurer with the commissioner must not be approved unless it includes an appropriate reduction in the premium charged when the principal operator of the insured automobile is insured under the policy, is fifty-five years of age or older, and has completed successfully a motor vehicle accident prevention course approved by the South Carolina Department of Highways and Public Transportation.
(B) The premium reduction is effective for three years after successful completion of the course, except the insurer may require, as a condition of providing and maintaining the reduction, that the insured must not be involved in a 'chargeable accident', as defined in Section 38-73-455(A)(3). An approved course must be completed successfully every three years to allow an insured to be eligible for the reduction.
(C) This section does not apply if the participation in the course is required by a court as the result of a driving violation."
SECTION 2. This act takes effect upon approval by the Governor.
