A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-2095 SO AS TO ALLOW A COMMERCIAL DRIVER LICENSE OR A COMMERCIAL DRIVER INSTRUCTION PERMIT TO BE ISSUED TO A PERSON DESIRING TO DRIVE A COMMERCIAL VEHICLE IN THIS STATE SOLELY IN INTRASTATE COMMERCE NOTWITHSTANDING FAILURE TO MEET THE STANDARDS IMPOSED BY CERTAIN FEDERAL REGULATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-1-2095. A person desiring to drive a commercial motor vehicle on the highways of this State solely in intrastate commerce may receive a commercial driver license or a commercial driver instruction permit for that purpose notwithstanding failure to meet the standards imposed by Regulation E 391.4l(10), Federal Motor Carrier Physical Standards, so long as the person satisfies the otherwise applicable requirements for the license or the permit imposed by this article."

SECTION 2. This act takes effect upon approval by the Governor.
