TO AMEND SECTION 12-23-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EXEMPTION OF LICENSE TAXES, SO AS TO EXEMPT ELECTRIC POWER OR ENERGY GENERATED BY A FACILITY WHERE THE PRIMARY ENERGY SOURCE IS DERIVED FROM CERTAIN RESOURCES AND UNDER CERTAIN CONDITIONS OR THE FACILITY GENERATING THE ELECTRIC POWER OR ENERGY QUALIFIES UNDER THE PUBLIC UTILITY REGULATORY POLICIES ACT OF 1978 (P.L. 95-617).
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 12-23-20 of the 1976 Code is amended by adding:
"(9) Electric power or energy generated by any facility where:
(a) the primary energy source is biomass, waste, renewable resources including but not limited to water and solar, geothermal resources, or any combination of them and is owned by any person or corporation other than a person or corporation, their lessees, assignees, trustees, receivers, or other successors in interest owning or operating in this State equipment or facilities for generating, transmitting, delivering, or furnishing electricity for street, railway, or other public uses or for the production of power or energy directly to or for the public for compensation; or
(b) the facility is a qualifying facility under the Public Utility Regulatory Policies Act of 1978, as amended, (P.L. 95-617)."
SECTION 2. This act takes effect upon approval by the Governor.
