A BILL

TO AMEND CHAPTER 3, TITLE 16, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-80 SO AS TO ESTABLISH THE "HOME PROTECTION BILL OF RIGHTS".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 3, Title 16 of the 1976 Code is amended by adding:

"Section 16-3-80. A person who is occupying a dwelling is presumed to have a reasonable belief in the existence of a danger requiring the use of deadly force, without retreating, against an intruder who unlawfully breaks and enters the dwelling. The State shall rebut this presumption by proof beyond a reasonable doubt. This section is known as the `Home Protection Bill of Rights'."

SECTION 2. This act takes effect upon approval by the Governor.
