A JOINT RESOLUTION REQUIRING A SPECIAL ELECTION TO BE CONDUCTED ON TUESDAY, MARCH 26, 1991, TO FILL A VACANCY IN THE HOUSE OF REPRESENTATIVES, DISTRICT 54, IN MARLBORO COUNTY.
Whereas, Representative John I. Rogers, III, House District 54, resigned from the House of Representatives on January 8, 1991; and
Whereas, Senator John C. Lindsay of Marlboro County died on January 11, 1991; and
Whereas, Marlboro County is without resident representation during a critical time when reapportionment of the House and Senate is to be considered by the General Assembly; and
Whereas, Douglas Jennings, Jr., has been declared the Democratic nominee for House District 54; and
Whereas, the provisions of Section 7-11-90, Code of Laws of South Carolina, 1976, provide for the dispensing of a primary when a candidate is unopposed; and
Whereas, pursuant to the provisions of Section 7-13-190, the filing time for nomination of candidates by other political parties and the filing of petition candidates for House District 54 ended at 12:00 noon, February 4, 1991, and no other candidate had filed by that time; and
Whereas, it is important to expedite the election process so as to allow the citizens of Marlboro County to be represented as soon as possible. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Special election
SECTION 1. Notwithstanding the provisions of Section 7-13-190, Code of Laws of South Carolina, 1976, relating to the time of holding a special election to fill a vacancy in an office, a special election must be conducted on Tuesday, March 26, 1991, to fill a vacancy in House of Representatives District 54.
Time effective
SECTION 2. This joint resolution takes effect upon approval by the Governor.
