A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-15-379 SO AS TO PROHIBIT THE VIEWING OR POSSESSING OF ANY MATERIAL OR PERFORMANCE THAT SHOWS A MINOR ENGAGED IN SEXUAL ACTIVITY, SEXUALLY EXPLICIT NUDITY, OR OTHER CONDUCT HARMFUL TO MINORS, TO PROVIDE A DEFINITION, AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-15-379. It is unlawful for a person to possess or view any material or performance that shows a minor engaged in sexual conduct as defined in Section 16-15-305, sexual activity as defined in Section 16-15-375, sexually explicit nudity as defined in Section 16-15-375, or engaged in other conduct harmful to minors as defined in Section 16-15-375. 'Minor' means a person under the age of eighteen. A person who violates this section is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than six months or fined not more than five hundred dollars, or both."

SECTION 2. This act takes effect upon approval by the Governor.
