A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-3-305 SO AS TO REQUIRE THE APPROVAL OF THE GOVERNING BODY OF THE AFFECTED COUNTY BEFORE A MUNICIPALITY MAY ANNEX AN AREA IN A COUNTY WHERE THE MUNICIPALITY IS NOT CURRENTLY LOCATED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 3, Title 5 of the 1976 Code is amended by adding:

"Section 5-3-305. Before a municipality may annex an area of a county in which it is not located, the governing body of the county whose area is proposed to be annexed must consent to the annexation by written resolution."

SECTION 2. This act takes effect upon approval by the Governor.
