To whom was referred a Bill (H. 3590), to amend the Code of Laws of South Carolina, 1976, by adding Section 38-77-245 so as to provide that when a uninsured motor vehicle is involved in an accident, etc., respectfully
That they have duly and carefully considered the same, and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking all after the enacting words and inserting:
/SECTION 1. The 1976 Code is amended by adding:
"Section 38-77-245. When a person knowingly operates an uninsured motor vehicle and is involved in a motor vehicle accident where the driver of the other vehicle who is insured is at fault, the driver of the uninsured vehicle may not recover damages for the injury or destruction of property."
SECTION 2. This act takes effect upon approval by the Governor./

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-245 SO AS TO PROVIDE THAT WHEN A UNINSURED MOTOR VEHICLE IS INVOLVED IN AN ACCIDENT WHERE THE INSURED DRIVER OF THE OTHER VEHICLE IS AT FAULT, THE UNINSURED DRIVER, IF ANY, IS ENTITLED TO ACTUAL DAMAGES FOR BODILY INJURY ONLY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-77-245. When an uninsured motor vehicle is involved in a motor vehicle accident where the driver of the other vehicle who is insured is at fault, the uninsured driver, if any, is entitled to actual damages for bodily injury only."
SECTION 2. This act takes effect upon approval by the Governor.
