A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-37-223 SO AS TO PROVIDE THAT THE GOVERNING BODY OF ANY COUNTY OR MUNICIPALITY UNDER CERTAIN CONDITIONS MAY DECREASE THE TAX MILLAGE LEVIED AGAINST ANY REAL PROPERTY WHICH HAS BEEN DAMAGED BY NATURAL DISASTER OR CHEMICAL CONTAMINATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 12-37-223. The governing body of any county or municipality may decrease the tax millage levied against any real property which in the opinion of that governing body has been damaged by natural disaster or chemical contamination. The millage may be reduced only in the year of the disaster or the discovery of the contamination to reflect the governing body's opinion of the decrease in the fair market value of the property as a result of the disaster or contamination when there is not sufficient time remaining in that year to reassess the property."

SECTION 2. This act takes effect upon approval by the Governor.
