TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-73-761 SO AS TO PROHIBIT A MOTOR VEHICLE INSURER FROM ASSESSING OR IMPOSING A SURCHARGE ON ITS INSURED AS THE RESULT OF A MOTOR VEHICLE ACCIDENT WHEN THE INSURED OR OTHER OPERATOR HAS NOT BEEN CONVICTED OF A MOVING TRAFFIC VIOLATION IN CONNECTION WITH THE ACCIDENT, UNLESS THE INSURER PAYS A CLAIM FOR DAMAGE IN CONNECTION WITH THE ACCIDENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-73-761. Notwithstanding the provisions of Section 38-73-760 or any other provision of this title, no motor vehicle insurer doing business in this State shall assess or impose a surcharge upon its insured as the result of a motor vehicle accident when the insured or other operator of the motor vehicle has not been convicted of a moving traffic violation in connection with the accident, unless the insurer pays a claim for damage in connection with the accident."
SECTION 2. This act takes effect upon approval by the Governor.
