A Bill to amend the Code of Laws of South Carolina, 1976, by adding Section 38-73-761 so as to prohibit a motor vehicle insurer from assessing or imposing a surcharge on its insured as the result of a motor vehicle accident when the insured or other operator has not been convicted or a moving traffic violation in connection with the accident, unless the insurer pays a claim for damage in connection with the accident.
