A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-7-235 SO AS TO PROVIDE THAT A CERTIFICATE OF NEED FOR A HEALTH CARE FACILITY MAY NOT BE ISSUED TO A PERSON OR TO AN ENTITY UNLESS THE PERSON TO WHOM THE CERTIFICATE IS ISSUED OR THE PERSON OWNING MOST OF THE ENTITY TO WHICH THE CERTIFICATE IS ISSUED IS ENGAGED FULL TIME IN PERFORMING THE HEALTH CARE SERVICE FOR WHICH THE CERTIFICATE OF NEED IS SOUGHT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-7-235. A certificate of need for a health care facility may not be issued to a person or entity unless the person to whom the certificate of need is issued, or the person who owns most of the entity to whom the certificate of need is issued, is engaged full time in performing the health care service for which the certificate of need is sought. For the purpose of this section, 'person' means an individual or organization, or any combination of them."

SECTION 2. This act takes effect upon approval by the Governor.
