TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-103-200 SO AS TO REQUIRE THE COMMISSION ON HIGHER EDUCATION TO DEVELOP GUIDELINES TO ENSURE THAT INSTRUCTORS AT INSTITUTIONS OF HIGHER EDUCATION ARE PROFICIENT IN ENGLISH, THAT GRIEVANCE PROCEDURES FOR STUDENTS WITH INSTRUCTORS WHO ARE NOT ABLE TO SPEAK ENGLISH ARE ESTABLISHED, AND THAT AN ANNUAL REPORT OF THE COMPLAINTS AND THEIR DISPOSITIONS IS MADE TO THE COMMISSION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-103-200. By school year 1991-92, the State Commission on Higher Education, in consultation with the public institutions of higher education, shall develop guidelines to ensure that all instructors employed or being considered for employment by the public institutions of higher education are proficient in speaking the English language so that they may adequately instruct students. At a minimum, the guidelines must include the procedures to ensure that all faculty members and instructors are proficient in both the written and spoken English language, procedures to inform students of grievance procedures regarding instructors who are not able to speak the English language, and a method for reporting annually grievances and their dispositions to the Commission on Higher Education."
SECTION 2. This act takes effect upon approval by the Governor.
