TO PROVIDE FOR THE ELECTION OF ALL MEMBERS OF BOARDS OF TRUSTEES OF SCHOOL DISTRICTS WHO ARE ELECTED AND ALL MEMBERS OF THE GOVERNING BODIES OF MUNICIPALITIES IN NONPARTISAN ELECTIONS TO BE HELD ON THE SECOND TUESDAY IN APRIL OF EACH YEAR, TO PROVIDE FOR THE METHOD OF NOMINATION OF CANDIDATES AND CONDUCT OF THE ELECTION, AND TO EXTEND THE TERMS OF THOSE PERSONS AFFECTED BY THESE PROVISIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Beginning in 1992, all members of boards of trustees of school districts who are elected and members of the governing bodies of municipalities must be elected in nonpartisan elections on the second Tuesday in April of each year.
SECTION 2. If the election day, as provided for in Section 1 of this act, occurs before the end of the term of any person affected by this act, the term is extended until his successor is elected on the second Tuesday in April of the following year. The terms of all persons elected pursuant to this act begin on the first day of May following the election for the terms for which they were elected.
SECTION 3. (A) Candidates for office which are filled in nonpartisan elections on the effective date of this act must be nominated by the method provided by law for the office affected.
(B) Candidates for office which are filled in partisan elections on the effective date of this act must be nominated as provided in Section 7-11-70 of the 1976 Code.
SECTION 4. The election provided for in this act must be conducted pursuant to the provisions of Title 7, Code of Laws of South Carolina, 1976, mutatis mutandis, except as otherwise provided for in this act.
SECTION 5. This act takes effect upon approval by the Governor.
