A BILL

TO AMEND SECTION 12-51-95, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REDEMPTION OF A MOBILE HOME OR MODULAR HOME BY THE OWNER FOR THE NONPAYMENT OF TAXES, SO AS TO FURTHER PROVIDE FOR THE TERMS AND CONDITIONS OF THIS REDEMPTION INCLUDING THE PERSONS WHO ARE AUTHORIZED TO MAKE THE REDEMPTION, AND TO REPEAL SECTION 12-51-96, RELATING TO CERTAIN CONDITIONS FOR REDEMPTION OF A MOBILE HOME OR MODULAR HOME.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The General Assembly finds that different conditions are imposed for the redemption of a mobile or modular home than apply to other homes or residences. The owner presently must pay rent to the high bidder during the redemption period, which sometimes results in substantial payments that far exceed the bid for the property. The purpose of this act is to treat the redemption of mobile or modular homes in the same manner as other homes except that the mobile or modular homes are not to be moved.

SECTION 2. Section 12-51-95 of the 1976 Code is amended to read:

"Section 12-51-95. Notwithstanding the provisions of Section 12-51-110, the owner The defaulting owner, or any grantee or secured creditor of the defaulting owner of any `mobile home' or `modular home', as defined in Section 31-17-20, may redeem the property as provided for in Sections 12-51-90, 12-51-100, and 12-51-120. The mobile or modular home must not be moved from its location at the time of levy and sale during the redemption period unless earlier redeemed."

SECTION 3. Section 12-51-96 of the 1976 Code is repealed.

SECTION 4. This act takes effect upon approval by the Governor.
