TO PROVIDE THAT THE ELECTION WHICH CERTAIN STATE RETIREMENT SYSTEMS ALLOW A MEMBER OF THAT RETIREMENT SYSTEM TO MAKE, WHEREBY MONTHLY OR OTHER CONTRIBUTIONS TO THE SYSTEM MAY BE PAID BY HIM ON THE BASIS OF HIS THEN EARNABLE COMPENSATION DURING THE TIME HE IS ON A LEAVE OF ABSENCE ON ACCOUNT OF MILITARY SERVICE, MAY BE MADE BEFORE THE MEMBER GOES ON THIS LEAVE OF ABSENCE OR AFTER THE MEMBER RETURNS TO HIS COVERED EMPLOYMENT FROM THE LEAVE OF ABSENCE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Notwithstanding any other provision of law, the election which any provision of Chapter 1, Chapter 8, Chapter 9, and Chapter 11 of Title 9 of the 1976 Code allows a member of that retirement system to make, whereby monthly or other contributions to the system may be paid by him on the basis of his then earnable compensation during the time he is on a leave of absence on account of military service, may be made before the member goes on this leave of absence or after the member returns to his covered employment from the leave of absence. If any of the above retirement systems by statute or regulation do not permit such an election, the provisions of this section are deemed to provide one.
The Budget and Control Board by regulation shall implement the provisions of this section.
SECTION 2. This act takes effect upon approval by the Governor.
