TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY REENACTING SECTION 50-11-25 SO AS TO PROVIDE THAT A BLIND FOR HUNTING MIGRATORY WATERFOWL ON PUBLIC LAND MUST BE CONSTRUCTED OF BIODEGRADABLE MATERIALS, THAT IT IS FOR PUBLIC USE AND NOT UNDER THE CONTROL OF THE PERSON WHO CONSTRUCTED IT, AND TO ESTABLISH A MISDEMEANOR FOR HUNTING MIGRATORY WATERFOWL FROM A BLIND MORE THAN TEN FEET ABOVE SURFACE LEVEL AND TO PROVIDE PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 50-11-25 of the 1976 Code, as repealed by Act 561 of 1988, is reenacted to read:
"Section 50-11-25. (A) Blinds constructed on public lands or waters of this State for use in hunting migratory waterfowl must be constructed of biodegradable materials.
(B) A blind for hunting migratory waterfowl built on public lands or waters belongs to the public for use by the public on a first come, first serve basis and is not the property of nor subject to control by the person who constructed the blind except during the time the blind is occupied physically for hunting by that person.
(C) It is unlawful to take, kill, hunt, or attempt to take, kill, or hunt migratory waterfowl from a blind more than ten feet above the ground or water. A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
