A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 46-1-160 SO AS TO REQUIRE PUBLIC UTILITIES AND THE SOUTH CAROLINA DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION TO NOTIFY RESIDENTS WHO LIVE WITHIN ONE HUNDRED YARDS OF A SITE TO WHICH HERBICIDES ARE TO BE APPLIED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 46-1-160. Before applying a herbicide to property under the ownership, control, or use of a public utility or the South Carolina Department of Highways and Public Transportation, the utility or department shall notify persons residing within one hundred yards of the site to which the herbicide is to be applied by placement of clearly visible signs in the area at least forty-eight hours before application."

SECTION 2. This act takes effect upon approval by the Governor.
