AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 52-7-65 SO AS TO PROVIDE THAT THE CHIEF COMMISSIONER OF THE STATE ATHLETIC COMMISSION MAY DISCIPLINE ANY LICENSEE OF THE COMMISSION FOR VIOLATIONS OF APPLICABLE LAW OR REGULATIONS BY LICENSE SUSPENSION OR A CIVIL PENALTY NOT EXCEEDING FIVE HUNDRED DOLLARS, TO PROVIDE THAT EACH DAY A VIOLATION CONTINUES IS A SEPARATE VIOLATION, AND TO PROVIDE THAT DISCIPLINARY DECISIONS OF THE CHIEF COMMISSIONER ARE APPEALABLE TO THE FULL COMMISSION; AND TO AMEND SECTION 52-7-60, RELATING TO THE DISCIPLINARY AUTHORITY OF THE STATE ATHLETIC COMMISSION, SO AS TO PROVIDE THAT THE DISCIPLINARY AUTHORITY OF THE COMMISSION EXTENDS TO ANY LICENSEE OF THE COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

Violations

SECTION 1. Article 1, Chapter 7, Title 52 of the 1976 Code is amended by adding:

"Section 52-7-65. In addition to the disciplinary powers of the full commission provided in Section 52-7-60, the chief commissioner may discipline a licensee of the commission who violates the provisions of this article or the applicable regulations by means of license suspension or a civil penalty not exceeding five hundred dollars for each violation. Each day a violation continues is a separate violation. Disciplinary actions of the chief commissioner are appealable to the full commission."

SECTION 2. Section 52-7-60 of the 1976 Code is amended to read:

"Section 52-7-60. The commission may revoke any license, after hearing, for cause. It may discipline any principal, manager, second, promoter, matchmaker, participant, or other licensee who violates the provisions of this article or the applicable regulations. Disciplinary action may take the form of a civil penalty or revocation or suspension of a license held by a licensee connected with the violation for all or any part of the unexpired portion and a refusal to renew a license, or both."

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
