AN ACT TO PROVIDE FOR THE ELECTION OF THE LEXINGTON COUNTY BOARD OF EDUCATION IN A NONPARTISAN ELECTION HELD AT THE TIME OF THE GENERAL ELECTION, TO REDUCE THE TERMS OF BOARD MEMBERS FROM FIVE YEARS TO FOUR, AND TO PROVIDE TRANSITION PROVISIONS RELATING TO THE TERMS OF CURRENT MEMBERS, TO PROVIDE FOR THE METHOD OF FILLING VACANCIES ON THE LEXINGTON COUNTY BOARD OF EDUCATION AND ON SCHOOL DISTRICT BOARDS OF TRUSTEES IN LEXINGTON COUNTY INCLUDING THE RICHLAND COUNTY PORTION OF SCHOOL DISTRICT 5, AND TO PROHIBIT CERTAIN POLITICAL ACTIVITY BY CANDIDATES FOR THE LEXINGTON COUNTY BOARD OF EDUCATION.

Be it enacted by the General Assembly of the State of South Carolina:

Lexington County Board of Education

SECTION 1. Beginning with the general election of 1994, members of the Lexington County Board of Education must be elected in a nonpartisan election held at the time of the general election for terms of four years and until their successors are elected and qualify. The terms of members begin on the Monday following the certification of the results of the election.

Transition terms

SECTION 2. The terms of members of the Lexington County Board of Education in office on the effective date of this act are terminated or extended as follows:

(1) Terms scheduled to expire in 1997 and 1998 terminate when successors, who must be elected at the time of the 1994 general election, assume office.

(2) Terms scheduled to expire in 1994 are extended until successors, who must be elected at the time of the general election of 1994, assume office.

(3) Terms scheduled to expire in 1995 and 1996 are extended until successors, who must be elected at the time of the general election of 1996, assume office.

Filling vacancies

SECTION 3. If a vacancy occurs on the Lexington County Board of Education or on a school district board of trustees in Lexington County, including that portion of Richland-Lexington County School District 5 in Richland County:

(1) less than one hundred eighty days before the next general election, the office remains vacant and the vacancy must be filled for the unexpired term or a full term as appropriate in an election held at the time of the general election;

(2) one hundred eighty days or more before the next general election, then the vacancy must be filled for the unexpired term in a special election held as provided in Section 7-13-190(C).

A member elected in a special election assumes office on the Monday following the certification of the result of the special election.

Certain political activity prohibited

SECTION 4. Candidates for the office of a member of the Lexington County Board of Education are prohibited from soliciting or accepting a contribution, gift, loan, or any other thing of value from a certified political party or from any person or entity acting for or on behalf of a certified political party. No candidate, candidate's committee, or person or entity acting for or on behalf of a candidate or candidate's committee may publish or distribute campaign literature which in any way states, implies, or suggests party affiliation.

Time effective

SECTION 5. This act takes effect upon approval by the Governor.
