A BILL

TO AMEND SECTION 42-19-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROVISION THAT RECORDS OF THE STATE WORKERS' COMPENSATION COMMISSION, IN CERTAIN SITUATIONS, SHALL NOT BE OPEN TO THE PUBLIC AND CERTAIN EXCEPTIONS TO THIS PROVISION, SO AS TO ALLOW ACCESS TO THESE RECORDS BY STATE AGENCIES SATISFYING THE COMMISSION OF THEIR INTEREST AND OF THE RIGHT TO INSPECT THE RECORDS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 42-19-40 of the 1976 Code is amended to read:

"Section 42-19-40. The records of the commission, in so far as they refer to accidents, injuries, and settlements, shall not be open to the public, but only to parties and other state agencies satisfying the commission of their interest in such records and of the right to inspect them."

SECTION 2. This act takes effect upon approval by the Governor.
