A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-23-195 SO AS TO MAKE IT UNLAWFUL FOR A DEALER TO SELL OR OTHERWISE TRANSFER TO A PURCHASER A WATERCRAFT WITH AN OUTBOARD MOTOR WHICH HAS HORSEPOWER IN EXCESS OF THAT FOR WHICH THE WATERCRAFT IS RATED AND TO PROVIDE PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 50-23-195. Any dealer selling or otherwise transferring to a purchaser a watercraft with an outboard motor which has horsepower in excess of that for which the watercraft is rated is guilty of a misdemeanor and, upon conviction, must be punished as provided in Section 50-23-280(b)."

SECTION 2. This act takes effect upon approval by the Governor.
