TO AMEND SECTION 1-11-730, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS ELIGIBLE TO PARTICIPATE IN STATE INSURANCE PLANS, SO AS TO PROVIDE THAT PERSONS WHO HAVE TERMINATED STATE EMPLOYMENT WITH AT LEAST NINETEEN YEARS OF SERVICE BUT WITH LESS THAN TWENTY YEARS OF SERVICE MAY RETURN TO COVERED EMPLOYMENT FOR THAT PERIOD NECESSARY TO ACHIEVE TWENTY YEARS OF SERVICE AND, IN THIS EVENT, ARE ELIGIBLE TO PARTICIPATE IN THE STATE HEALTH AND DENTAL INSURANCE PLANS WHETHER OR NOT THE LAST FIVE YEARS OF STATE EMPLOYMENT WERE CONSECUTIVE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1-11-730(A) of the 1976 Code, as added by Act 364 of 1992, is amended to read:
"(A) A person covered by the state health and dental insurance plans who terminates employment with at least twenty years retirement service credit by a state-covered entity before eligibility for retirement under a state retirement system is eligible for the plans effective on the date of retirement under a state retirement system, if the last five years are consecutive and in a full-time permanent position with a state-covered entity. Persons who terminated state employment with at least nineteen years of service but with less than twenty years of service may return to covered employment for that period necessary to achieve twenty years of service and, in this event, are eligible to participate in the state health and dental insurance plans whether or not the last five years of state employment were consecutive."
SECTION 2. This act takes effect upon approval by the Governor.
