TO DIRECT THE SOUTH CAROLINA DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO ADOPT BIOREMEDIATION AS AN ACCEPTABLE TECHNOLOGY FOR TREATING APPROPRIATE HAZARDOUS WASTE, TO AUTHORIZE AND REQUIRE ITS USE ON AT LEAST TWENTY-FIVE PERCENT OF ITS SITES BY JANUARY 1, 1994; TO REQUIRE THE DEPARTMENT TO REVIEW ITS STATUTORY AND REGULATORY LAW AND MAKE CHANGES NECESSARY TO FACILITATE THE USE OF BIOREMEDIATION, AND TO DIRECT THE DEPARTMENT TO DO A COST ANALYSIS AND TO EVALUATE THE EFFECTIVENESS OF USING THIS TECHNOLOGY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) The South Carolina Department of Health and Environmental Control shall adopt bioremediation as an acceptable technology for treating appropriate hazardous waste. Notwithstanding any other provision of law the department is authorized to use bioremediation and by June 30, 1994, must be using this technology on at least twenty-five percent of its sites, if possible.
(B) The department shall review its statutory and regulatory law to determine changes necessary to remove impediments to using bioremediation and to facilitate its use. The department shall report the findings of this review to the General Assembly and shall initiate changes in its regulations by June 30, 1994.
(C) The department shall conduct a cost analysis for and evaluate the effectiveness of using bioremediation technology in treating hydrocarbons, shall compare this with other treatment methods used at comparable sites, and shall report these findings to the General Assembly by June 30, 1995.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
