A JOINT RESOLUTION

TO PROVIDE FOR A REFERENDUM TO BE HELD AT THE SAME TIME AS THE 1994 GENERAL ELECTION TO ASCERTAIN THE WISHES OF THE QUALIFIED ELECTORS OF THIS STATE AS TO WHETHER OR NOT A FLAG OF THE CONFEDERACY SHOULD BE FLOWN ABOVE THE STATE HOUSE, AND, IF SO, THEIR PREFERENCE AS TO WHETHER OR NOT IT SHOULD BE THE CONFEDERATE BATTLE FLAG OR THE STARS AND BARS FLAG, TO PROVIDE FOR THE MANNER IN WHICH THIS REFERENDUM SHALL BE CONDUCTED, AND TO PROVIDE THAT IF A MAJORITY OF THOSE VOTING IN THE REFERENDUM VOTE IN FAVOR OF HAVING A FLAG OF THE CONFEDERACY FLY ABOVE THE STATE HOUSE, THE TYPE OF CONFEDERATE FLAG REFERRED TO ABOVE RECEIVING THE HIGHEST NUMBER OF VOTES IN THE REFERENDUM MUST BE FLOWN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. (A) A statewide referendum must be held at the same time as the 1994 general election to ascertain the wishes of the qualified electors of this State as to whether or not a flag of the Confederacy should be flown above the State House, and, if so, their preference as to whether or not it should be the Confederate Battle Flag or the Stars and Bars Flag. The State Election Commission must place the questions contained herein on the general election ballot in November, 1994. The state election laws shall apply to the referendum, mutatis mutandis. The State Board of Canvassers shall publish the results of the referendum and certify them to the Secretary of State. If the result of Question Number One in this referendum is in favor of flying a Confederate flag above the State House, the flag receiving the highest number of votes in Question Number Two must be flown beginning upon the certification of the referendum results.

(B) (1) The first question put before the voters at the 1994 referendum shall read as follows:

"Do you favor flying a flag of the Confederacy above the State House in Columbia?"

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word `Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word `No'."

(2) The second question put before the voters at the 1994 referendum shall read as follows:

"If you voted `yes' to Question Number One, which of the two Confederate flags listed below do you favor?

[] Confederate Battle Flag

[] Confederate Stars and Bars Flag"

Those voting in favor of the Confederate Battle Flag shall deposit a ballot with a check or cross mark in the square after the words "Confederate Battle Flag", and those voting in favor of the Confederate Stars and Bars Flag shall deposit a ballot with a check or cross mark in the square after the words "Confederate Stars and Bars Flag".

SECTION 2. This joint resolution takes effect upon approval by the Governor.
