TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1085 SO AS TO MAKE IT UNLAWFUL FOR A PERSON TO USE, SOLICIT, INDUCE, COERCE, OR EMPLOY A PERSON UNDER SEVENTEEN YEARS OF AGE TO COMMIT A FELONY, TO ALSO MAKE IT UNLAWFUL TO CONSPIRE TO DO THE ABOVE, AND TO PROVIDE PENALTIES FOR VIOLATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-3-1085. (A) It is unlawful for a person to knowingly and intentionally:
(1) use, solicit, direct, hire, persuade, induce, entice, coerce, or employ a person under seventeen years of age to commit a felony;
(2) conspire to use, solicit, direct, hire, persuade, induce, entice, coerce, or employ a person under seventeen years of age to commit a felony;
(B) A person who violates subsection (A)(1) or (A)(2) is guilty of a felony and, upon conviction, must be punished as if the person committed the felony committed by the person under seventeen years of age. Each violation of this section constitutes a separate offense.
(C) The felonies established in this section are supplemental to any other provisions of law which make the conduct referred to in subsection (A) unlawful."
SECTION 2. This act takes effect upon approval by the Governor.
