A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING CHAPTER 30 TO TITLE 46 SO AS TO PROVIDE FOR A REFERENDUM TO APPROVE AN ASSESSMENT ON MARKETED TOBACCO TO PROVIDE FUNDS FOR TOBACCO PRODUCTION RESEARCH.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"CHAPTER 30

South Carolina Tobacco Research

Section 46-30-10. A referendum must be held in every county in South Carolina in which flue-cured tobacco is produced on the question as to whether an assessment of ten cents for each one hundred pounds of tobacco marketed may be used to provide funds to the South Carolina Tobacco Foundation, Inc., for research and dissemination of research facts concerning tobacco production. The referendum must be conducted by the foundation.

Section 46-30-20. Only individual flue-cured tobacco quota holders as designated by the Agriculture Stabilization and Conservation Service of the United States Department of Agriculture may participate in the referendum. Two-thirds of the tobacco producers voting is required for approval of the referendum.

Section 46-30-30. If the referendum is approved, the assessment may be collected for four years by the foundation from the tobacco producers as defined in Section 46-30-20. Another referendum must be held in four years and each four years after approval to confirm the approval of the assessment. If the referendum is not approved it must not be offered again for approval for one year.

Section 46-30-40. A person or organization who receives funds from the foundation pursuant to the assessment shall file quarterly written reports with the foundation on the receipt and expenditure of the funds.

Section 46-30-50. A tobacco producer assessed pursuant to this section may receive a refund of his assessment if a request is made in writing to the foundation within thirty days of collection of the assessment."

SECTION 2. Referendums must be held pursuant to Chapter 30, Title 46 of the 1976 Code within six months of this act's effective date.

SECTION 3. This act takes effect upon approval by the Governor.
