TO AMEND SECTION 44-113-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CONDITIONS UNDER WHICH A HEALTH CARE PROVIDER MAY REFER A PATIENT TO AN ENTITY IN WHICH THE HEALTH CARE PROVIDER IS AN INVESTOR, SO AS TO PROVIDE THAT THESE PROVISIONS DO NOT APPLY TO HEALTH CARE PROVIDERS WHO ARE PERSONALLY INVOLVED IN THE PROVISION, SUPERVISION, OR DIRECTION OF CARE TO THEIR PATIENTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 44-113-40 of the 1976 Code, as added by Act 71 of 1993, is further amended by adding:
"(C) This section does not apply to health care providers who are personally involved in the provision, supervision, or direction of care to their patients."
SECTION 2. This act takes effect upon approval by the Governor.
